Website usage terms and conditions – FEISTY GOODS

Welcome to our website. If you continue to browse and use this website, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern FEISTY GOODS relationship with you in relation to this website. If you disagree with any part of these terms and conditions, please do not use our website. The term ‘you’ refers to the user or viewer of our website.

The use of this website is subject to the following terms of use:

  • The content of the pages of this website are for your general information and use only. It is subject to change without notice.

  • Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

  • We aim to display and present images of each product in real life. Due to screen monitor settings, the colours may therefore differ slightly, or in some cases greatly. Note that viewing content on different devices i.e. Mobile phones, laptops, tablets may alter colour. We can not therefore be held responsible or guarantee the item will be the exact same colour as your monitor settings. If unsure we encourage you to buy a sample if the option is available. However, great care has been taken to ensure that each of our products has been accurately described, measured and photographed.

  • If the item you have ordered is out of stock, you will be notified via email or contact number provided and offered an exchange or refund. If we fail to receive a response within 48 hours, we will refund the item. If you are purchasing more than 1 item, the remaining items will be dispatched and the out of stock items will be refunded to your account via the original payment method.

  • FEISTY GOODS will ask for photographic evidence when customers have received a damaged/faulty/wrong item.

  • We are always happy to help our customers and encourage you to contact us via the live chat function or emailing us. Please note that we cannot guarantee a response immediately and we will always do our utmost best to get back to you as soon as possible.

  • We are not responsible for orders not reaching the destination if the correct address is not provided by the customer.

  • Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements.

  • This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.

  • All trademarks reproduced in this website, which are not the property of, or licensed to the operator, are acknowledged on the website.

  • Unauthorised use of this website may give rise to a claim for damages and/or be a criminal offence.

  • Your use of this website and any dispute arising out of such use of the website is subject to the laws of England, Northern Ireland, Scotland and Wales.

  2. Customers are entitled to one use per transaction to use this code. Codes are case sensitive. To redeem the offer, you must enter the offer code at the online checkout and satisfy any minimum spend requirement in a single transaction.

  3. All customers are entitled to £10 off with purchases over £100. Use code FEISTY10 at checkout to redeem.

  4. The Promotion is available for all countries to which FEISTY GOODS currently delivers.

  5. FEISTY GOODS reserves the right to (i) cancel this Promotion (ii) refuse to allow any individual to participate in the Promotion and (iii) amend these terms and conditions (and will use reasonable endeavours to notify changes to all customers).

  6. These terms and conditions shall be governed by and construed in accordance with English law and shall be subject to the exclusive jurisdiction of the English courts in the event of a dispute.

 

Shipping & Orders placed before 2pm for same day dispatch
  • As stated we will dispatch all orders placed before 2pm on the same day.

  • If ordered after this time we will still endeavour to dispatch the same day as a gesture of goodwill, however please do not expect this as definite insurance that we will.

  • Any orders placed after 2pm are subject to the standard shipping service provided on our website. We aim to ship all orders within 2 working days, for delivery within 2-3 days. Our orders will be sent out via Royal Mail or Hermes.

  • FEISTY GOODS will not be held responsible if either company is at fault for late delivery. We will endeavour to our best degree to locate your parcel and find out when it is expected to arrive.

  • FEISTY GOODS cannot therefore guarantee a date of when orders will arrive.

  • In the rare occasion you do not receive your order within the given time slot provided, please email or use the live chat service if available and we will respond to you as soon as possible.

  • PLEASE NOTE: If there are delays to dispatching your order due to unforeseen circumstances we will contact you via the email address provided.

 

Return, exchanges and cancellations

We hope that you will be pleased with your purchase, however if you are unsatisfied for any reason or just wish to return the item, you can return it to FEISTY GOODS in its original packaging within 14 days of receipt. However please note that it is you the customer that will have to pay the return postage. Items damaged whilst in transit because of bad packaging will not be refunded. Items showing signs of wear, stains, smell perfume or anything else will not be refunded. FEISTY GOODS will contact you via email to inform you of this. CUSTOMERS are responsible for all shipping charges. All items are the responsibility of the customer until received by FEISTY GOODS and inspected. PRIVACY POLICY

SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION?

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.

When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates.


SECTION 2 - CONSENT

How do you get my consent?

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.


How do I withdraw my consent?

SECTION 3 - DISCLOSURE

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.


Payment:

If you choose a direct payment gateway to complete your purchase, then WIX stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
